Privacy Policy

Our members’ and other users’ privacy is very important to us. However, we collect and, in some cases, disclose information about your organization as part of the normal operation of our site. In this policy, “the Member” means your organization if your organization has registered for the Nursery Network Service, and “the User” means your organization in all other cases. This Privacy Policy describes the information we collect about Members and Users and what may happen to that information. As described below, some information we collect from Members or Users is disclosed to third parties and used by third parties and us. When the User uses the Nursery Network Site, the User expressly consents to such use and disclosure of the User’s information. When the Member accepts the member agreement, the Member expressly consents to such use and disclosure of the Member’s information.

Nursery Network may amend this Privacy Policy at any time by posting the amended policy on the Nursery Network site, and such amendments will become effective upon posting.

Information About Members, Users, and Transactions

Our site’s registration form requires Member to provide contact information and other registration information (including without limitation name, title, email address, street address, telephone number and fax number).

Our service will require Member to provide product information including without limitation item descriptions, prices, and quantities available (if Member is a seller) and items, prices and quantities desired (if Member is a buyer).

We will collect transaction information about the transactions Member conducts through our site (including without limitation price, quantity, description of items sold or purchased, shipping destination, and Member’s business practices).

Except as provided herein we do not disclose to non-members any Member’s contact information, or product or transaction information that identifies a Member specifically.

We may aggregate Member-specific information (including without limitation registration information, product information, and transaction information) and disclose such information in the aggregate for a number of business purposes, including without limitation distributing statistical analyses and reports, but in these situations we do not disclose to third parties any information that identifies a Member specifically. Also, we may use information about a Member to provide ads or offers from advertisers that we believe may be relevant.

In the course of using our site, we automatically track certain information about Members and Users. This information may include the URL that the Member or the User just came from (whether this URL is on our site or not), which URL the Member or the User next goes to (whether this URL is on our site or not), what browser the Member or the User is using, and the Member’s or the User’s IP address. We use this information in the normal operation of our site, and we may disclose this information on an aggregated basis.

We also use cookies on our site. Among other reasons, cookies allow us to require the Member’s personnel to enter their passwords only once during a session. Cookies can also help us provide advertising which is targeted to the Member’s and the User’s interests. Cookies are stored on the Members’ or the Users’ hard drives, not on our site. Most cookies are “session cookies,” meaning that they are automatically deleted at the end of a session. A Member or User is always free to decline our cookies if the Member’s or User’s browser permits, although in that case the Member’s personnel may be required to reenter their passwords multiple times during a session.

If a Member sends us correspondence, such as emails or letters, or if other users or third parties send us correspondence about the Member’s use of our services or the Member’s business practices, we may collect such information into a file specific to the Member. We may also collect other performance information about the Member’s payment history and the Member’s fulfillment performance, for transactions that the Member conducts through our site.

We may disclose this individualized performance information to other Members and third party rating agencies. We also use information in the file we maintain about the Member, and other information we obtain from the Member’s current and past use of our service, to resolve disputes, troubleshoot problems and enforce our member agreement.

Our Use of Member’s Name and Email Address

As part of our service, we may send to the Member periodic emails containing information about us, updates on new product features, product usage tips, information about third party services that we believe are likely to be of interest to the Member, and member satisfaction questions.

In addition to the periodic emails, we may use the Member’s email address to send member administrative notices about Member’s account (such as notices about pending transactions).

In addition, in order to provide the Member with certain features of the Nursery Network site or service that may be provided by our third party contractors or partners in the future, we may disclose some of the Member’s contact information, product information, transaction information, and performance information to these third party contractors and partners.

Third Party Collectors of Information and Public Information.

Our policy only addresses the use and disclosure of information we collect from the Member or the User through our servers. Other sites (including those third party sites or services that we co-brand) may have their own policies and practices, which we do not control, and thus are not addressed by this policy.

Also, to the extent that the Member or User discloses the Member’s or User’s information to other parties, such as in communications with other members or users in connection with transactions performed using our service, different rules may apply to their use or disclosure of the information the Member or User discloses to them. To the extent that we use third party advertisers, they adhere to their own privacy customs and policies. Because we do not control the privacy policies of third parties, we encourage the Member or User to ask questions before disclosing the Member’s or User’s proprietary information to others.

Our site may make electronic storefronts, chat rooms, forums, message boards and/or newsgroups available to the Member or User. The Member or User should bear in mind that any information disclosed in these areas is public information and may be disclosed to and used by third parties.

Nondisclosure Can’t Be Guaranteed

Due to the existing regulatory and technical environment, we cannot guarantee that all of our Members’ or Users’ communications, transaction information and other information that identifies Members or Users will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting the foregoing), we may be forced to disclose information to the government or third parties under certain circumstances, or third parties may unlawfully intercept or access a Member’s or User’s transmissions or communications. Further, we may disclose any information about a Member or a User to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate.

Security

We use industry-standard efforts to safeguard our Members’ specifically identifiable information, such as firewalls and 128-bit encryption technology. However, that said, “perfect security” does not exist on the Internet (or anywhere, for that matter.) In order to use our security technology, we require that the Member or User have either Netscape Navigator version 3.0 or later or Microsoft Internet Explorer version 3.0 or later.
